1. What Sortwell does

Sortwell finds duplicate and similar photos on your Android phone, suggests the best one and, once you confirm, moves the rest to the Android trash. The app can also shrink large videos. The provider is Mirza Tahirovic.

2. Trial and subscription

You can try Sortwell for 7 days without giving payment details.
After that you need a subscription through Google Play. Google Play shows you the price. You choose a monthly or a yearly plan; it renews automatically until you cancel.
You cancel in your Google Play subscriptions (in the app under Settings, "Manage subscription"), at any time before the next renewal date.
For consumers in Germany, in addition: after an automatic renewal of the yearly plan you can cancel at any time with one month's notice, also by email to kontakt@tahirolabs.com. We refund on a pro-rata basis any amounts already paid for the time after the contract ends.
Cancelling stops automatic renewal. It takes effect at the end of the current, already paid subscription period (month or year). Until that date Sortwell stays fully unlocked; Google Play shows you the end date. After that the app is locked without a subscription.
Google Play's rules apply to voluntary refunds. This does not affect your statutory rights, in particular a statutory right of withdrawal for consumers where it applies to you (in the EU, the EEA and the United Kingdom under the withdrawal information in section 7, in Brazil 7 days under Art. 49 of the Consumer Defence Code, CDC), and your statutory rights in case of defects.
After the trial the app is locked without a subscription.

3. Your responsibility

You decide what is deleted. Deleted items go to the Android trash and can be restored there for 30 days. After you empty the trash, or once the period ends, they are gone. Check your selection before you confirm.

4. Warranty and liability

The statutory provisions on warranty and liability apply. Statutory claims for defects, for example to have the defect fixed, to a price reduction, to end the contract or to a refund, remain unaffected. Liability for intent, gross negligence and personal injury is neither excluded nor limited. You can report defects to kontakt@tahirolabs.com.

The General Terms and Conditions of TahiroLabs also apply; where they conflict with these terms of use, these terms of use take precedence.

5. Governing law and jurisdiction

Swiss law applies. If you are a consumer with your habitual residence in another country, you keep the protection of that country's mandatory consumer protection rules; the choice of Swiss law does not deprive you of it. The statutory places of jurisdiction apply.

7. Withdrawal (cancellation) information

This information applies to consumers whose habitual residence is in the EU, the EEA or the United Kingdom. It concerns the subscription you take out through Google Play after the trial. In the United Kingdom, "withdraw" means "cancel".

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Mirza Tahirovic, Hagenholzstrasse 81, 8050 Zurich, Switzerland, phone +41 44 520 28 06, email kontakt@tahirolabs.com) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
